What is Investor KITAS?

Investor KITAS is a limited stay permit granted by the Directorate General of Immigration (DGI) for foreigners investing in Indonesia through a Foreign Investment Company (called PT PMA / Perusahaan Modal Asing). This permit enables you to live and manage your business in Indonesia, available in available in a few types:

  • E28A: Foreign investors can stay for 2 years (already available)
  • E28B: Foreign investors intending to set up a company in Indonesia can stay for 5 or 10 years.
  • E28C: Foreign investors not planning to establish a company in Indonesia can stay for 5 or 10 years.
  • ⁠E28D: Foreign investors serving on boards of Indonesian branches or subsidiaries can stay for 5 or 10 years.
  • E28E: Foreign investment in Special Economic Zones.
  • ⁠E28F: Foreign investment establishing branches or subsidiaries in Ibu Kota Nusantara (IKN) can stay based on investment regulations.

Benefits

According to the Amendments to Investment Coordinating Board Regulation number 5 of 2019, foreign shareholders are exempt from a mandatory USD 1,200 annual work permit fee with an Investor KITAS.

This permit grants a 2-year residence, extendable, and, after four consecutive years, eligibility for a Permanent Stay Permit (KITAP). Holding an Investor KITAS also allows you to open an Indonesian bank account, obtain a driving license, or access personal loans.

Qualifications

As of November 2, 2023, based on the latest Circular No. IMI-0315.GR.01.01 of 2023, and the Ministry of Law and Human Rights regulation No. 22 of 2023, foreign investors must have IDR 10 billion shares for investor KITAS and IDR 15 billion for investor KITAP application

However, applications for investor KITAS with a personal share value of at least IDR 1.1 billion are accepted until December 31, 2024.Applications for Investor KITAS with a personal share value of at least IDR 1.1 billion will be accepted until December 31, 2024. After this date, shareholders with a personal share value of less than IDR 10 billion will need to switch to a Work KITAS.

Register Residential Reports from Local Civil Office

  1. Scanned copy of passport and the passport cover. Passport validity not less than 30 (thirty) months expiration from the application date.
  2. Colored photograph, white background.
  3. Proof of sufficient funds of the recent period.
  4. Travel/Health insurance, or a Statement Letter willing to bear medical expenses independently during your stay in Indonesia.
  5. Details of staying address in Indonesia.
  6. Record/certificate of full-dose Covid vaccination.
  7. Company documents of Notarial Deed of Establishment or the latest amendment if any, Decree Approval of Establishment, Company Tax ID (NPWP), Business Registration Number (NIB), OSS documents, ID of the local PIC, and Company Profile from AHU system.

*Additional documents may be required due to implementation of new visa regulation.

Payment can be made via bank transfer or in cash at your convenience.

Eligibility

Investor KITAS is applicable to foreigners who have registered a business in Indonesia as a Foreign Direct Investment (PT PMA) and hold a personal shareholding value of at least IDR 10 billion in the company.

Work Permit Exemption

Foreigners in directorial positions with shares ownership are exempted from the Work Permit fees (DPKK fund) of US$100 per month.

Dependent KITAS:

The child or spouse of an Investor KITAS holder can be granted a Dependent KITAS.

KITAS to KITAP Transition

After four consecutive years of living in Indonesia with Investor KITAS, you may be eligible to switch to an Investor KITAP. The Investor KITAP is a 5-year stay permit extendable to unlimited durations.

Roles and Responsibilities

Investor KITAS holders serving as directors or commissioners must adhere to the guidelines outlined in Company Law number 40 of 2017. These responsibilities include directing, managing, and overseeing the company. Certain conditions exist where undertaking specific tasks hands-on may be restricted.

With shares valued at a minimum of IDR 10 billion, you are entitled to an Investor KITAS. Shares below IDR 10 billion make you eligible for a Work KITAS, as per the latest MoLHR regulation number 22 of 2023.

Yes, you can receive a salary on a monthly basis and/or annual dividends once the company is profitable.

Yes, after the 4th year of KITAS, you can apply for Investor KITAP through a Switching Status application approved by the Directorate General of Immigration (DGI).

Yes, by applying for a Switching Sponsor (Alih Penjamin/Sponsor) application. The old company sponsor must issue a Statement of No Objection for the transfer.

Yes, apply for Multi-position Reports (Rangkap Jabatan) to show your shareholder status in another company.
